The Problem at Scale

Counterfeit Goods in E-commerce Are Not a Fringe Problem

Most brand managers discover counterfeiting through a spike in 1-star reviews or a customer complaints call. By then the fake has already been purchased, unboxed, photographed, and posted. The data shows how large the exposure already is.

Where Things Go Wrong

Five Ways Counterfeiters Exploit Your E-commerce Presence

Listing Hijacking

A third-party seller attaches to your marketplace listing and ships a fake unit. The review lands on your product page saying your quality is poor. You had no idea the sale happened.

Counterfeit Returns

A buyer purchases a genuine product, swaps it with a fake, and returns the fake claiming your brand sold it. Your team issues a refund for a unit you never manufactured.

Fake Brand Storefronts

Sellers create storefronts using your name, logo, and product imagery. Buyers searching your brand end up on pages selling infringing goods they believe are yours.

Below-MAP Grey Listings

Diverted stock appears on marketplaces priced 40% below your MAP. Authorised dealers lose margin and motivation. Your pricing integrity and channel relationships break down.

Cross-Border Evasion

Counterfeiters sell from foreign marketplace accounts where your enforcement team has no jurisdiction. Product ships cross-border, clears customs as general merchandise, and lands with your customer.

Regulatory Requirements

Four Frameworks Your Legal Team Is Already Watching

If you sell in India, the US, Europe, or ship globally, at least two of these apply to your brand right now. Acviss maps its authentication infrastructure to each framework so your compliance team does not have to build separate systems.

INDIA Consumer Protection E-Commerce Rules 2020

E-commerce platforms and sellers must ensure product authenticity. Marketplaces are required to have a grievance mechanism and must take down listings found to be counterfeit or misleading once notified. Sellers bear liability for misrepresentation of product origin or authenticity.

Certify unit-level authentication gives your team the evidence needed to file a verified takedown under Rule 6 of the E-Commerce Rules.
USA FTC Enforcement + STOP Act 2020

The Strengthening Trade and Counterfeiting and Enforcement Act expands customs authority to seize counterfeit goods. The FTC requires accurate product representation, and marketplaces face increased scrutiny for third-party counterfeits on their platforms.

Phantom Code non-cloneable identifiers provide the forensic evidence required for STOP Act seizure requests and FTC complaints.
EUROPE EU Digital Services Act 2022

The DSA requires online platforms to implement notice-and-action mechanisms for illegal content including counterfeit goods. Very large platforms face stringent obligations for trader identification and product authenticity. Non-compliance attracts fines of up to 6% of global turnover.

Certify scan records and Truviss listing evidence create the documented notice required to trigger DSA takedown obligations on EU platforms.
GLOBAL GS1 / GTIN Product Identity Standards

GS1 GTINs are the foundation for product identification in global e-commerce. Platforms including Amazon and Walmart require GTIN compliance for listing products. Unauthorised GTIN usage is a grounds for listing removal and legal action.

Certify integrates with GS1 GTIN systems to layer cryptographic authentication on top of your existing product identity infrastructure.

Non-Cloneable Identity
Phantom Code

Phantom Code applies a non-reproducible physical identity to your packaging that cannot be replicated even with the original artwork. When a counterfeiter copies your label, Phantom Code fails on their print and passes on yours.

  • Non-cloneable covert identifier per unit
  • Fails on all known counterfeit replication methods
  • Forensic-grade evidence for legal and customs action
  • Works alongside standard QR codes and barcodes
  • No visible change to your packaging design

FAQ

Questions E-commerce Brand Teams Ask Us

The consumer opens their phone camera, points it at the QR code on the packaging, and taps the link. No app to download and no account to create. The authentication page shows within two seconds, confirming whether the product is genuine along with brand content you configure, such as product information, warranty registration, and a re-order link. The scan is logged with timestamp and location, which builds your data picture of where genuine product is reaching real buyers.
Yes. The Certify QR is applied at your factory or fulfilment centre directly to your product packaging before it enters the marketplace supply chain. The QR survives the marketplace's own outer carton, bubble wrap, and labels. As long as your product packaging is accessible when the consumer opens the box, the scan works. For products sold in manufacturer packaging inside a marketplace outer box, your team places the QR label on the inner unit. We work through the fulfilment flow with your operations team during onboarding.
Your returns processing team scans the returned unit's QR code before the refund is approved. If the unit was never part of your authenticated inventory, the scan returns a fail result immediately. If the same QR has already been scanned multiple times, the system flags it as a suspected swap. Your team gets a clear pass or flag result without needing to do a manual product inspection. This data is also used to build evidence files for marketplace dispute escalations.
Scan rates vary by category and consumer incentive. Without any in-box incentive, typical scan rates run between 8 and 15 percent of units shipped. When brands add a post-scan reward, warranty registration, or exclusive content, scan rates frequently reach 25 to 40 percent. The scan data is valuable regardless of rate because even a 10 percent sample across your entire shipment volume gives statistically meaningful intelligence on where genuine product is landing and where the gaps are.
Yes. Certify applies at the unit level at your factory or third-party fulfilment centre, before the unit is routed to either channel. The same authenticated unit can be shipped via your DTC store, Amazon, Flipkart, or any other channel. Your Certify dashboard shows scan events broken down by channel and geography, so you can compare authentication engagement and flag patterns across your different sales routes simultaneously.
